THE State Administrative Court Jakarta (PTUN) finally issued a decision regarding Elbie Piter Cs' lawsuit against the Ministry of Energy and Mineral Resources (Defendant I) and PT Tambang Mas Sangihe (Defendant of Intervention).
In case No. 146/G/2021/PTUN.Jkt, the court decided not to accept the claim from the plaintiffs. "Declare that the plaintiffs' claims and the intervening plaintiffs are not accepted," reads the verdict issued Wednesday, April 20, 2022.
The court then accepted the defendant's exception stating that the Administrative Court did not have competence or jurisdiction in that case. Where, the object of the lawsuit, namely the Decree of the Ministry of Energy and Mineral Resources is the result of a contract of work. In the contract of work, the Indonesian government has promised to issue an operating license for PT TMS.
In addition, the court also ordered the plaintiffs and the intervening plaintiffs to pay all costs incurred in the dispute amounting to Rp39,206,600.
When confirmed, PR PT TMS Cesylia Saroinsong confirmed this. "Yes. there has been a court decision regarding the lawsuit against PT TMS," she said.(*/ifa)
